How to Import 1.4G Consumer Fireworks into the USA
A buyer checklist for completed consumer fireworks: ATF exemptions, CPSC testing and eFiling, DOT documentation, and state restrictions.
Importing completed consumer fireworks that qualify for the ATF exemption generally does not require an ATF explosives importer license. It does require a separate review of consumer-product rules, transport classification, customs entry and state/local permissions. A carton marked UN0336, 1.4G is not proof that a product is lawful for retail sale. Start with the exact device, its supporting records and the rules at your destination.
The Three Federal Gatekeepers: ATF, CPSC, DOT
| Agency | Regulates | What the importer must do |
|---|---|---|
| ATF | Federal explosives controls and the completed-consumer-fireworks exemption | Confirm the actual products qualify; display fireworks need the applicable explosives licensing. |
| CPSC | Consumer-device safety, warnings and certification | Support a GCC with appropriate testing and complete applicable certificate eFiling. |
| DOT/PHMSA | Classification and hazardous-materials transportation | Match each device to the applicable approval/certification and compliant shipping records. |
ATF's fireworks guidance distinguishes completed consumer fireworks from their commercial manufacture and from display fireworks. The exemption does not cover every explosive product advertised as consumer fireworks.
For transport, check the current 49 CFR 173.64 and 49 CFR 173.65. Depending on the product and route through the rules, records may include an EX approval, an FC certification, or an FW number for eligible low-hazard ground devices. FW eligibility is limited; it is not a shortcut for cakes or every 1.4G product. Have your DG forwarder verify the exact authorization, packing, marks and carrier acceptance.
CPSC Port Testing: What Can Stop Your Shipment
Before loading, require a documented review of the applicable bans, performance requirements and warning labels in 16 CFR Parts 1500 and 1507. Assemble the product identity, testing basis and General Certificate of Compliance. A supplier's catalog statement that an item is “CPSC approved” does not replace these records: CPSC is the regulator, not a blanket factory-approval scheme.
As explained in the CPSC fireworks guidance, investigators can sample imported products at ports and examine composition, construction and labels. Failed devices cannot be sold in the United States. The scope of an import hold and its disposition depend on the agency's notice and findings; a failure does not automatically establish that every SKU is confiscated.
CPSC's certificate guidance sets July 8, 2026 as the general imported-product eFiling effective date and January 8, 2027 for covered FTZ entries. Coordinate applicable certificate data with your broker before entry. A GCC, an EX/FC/FW record and a customs filing answer different questions; none substitutes for the others.
If notified of detention, retain the notice, respond by its deadline and follow restrictions on movement and distribution. CPSC's detention FAQ explains the process, including possible conditional release. A Letter of Advice is not a universal name for every import enforcement notice. Refusal, corrective action, export or destruction depend on the case and agency authorization.
State Laws: Check the Destination Before Ordering
| Destination | Official starting point | Buyer implication |
|---|---|---|
| Massachusetts | State fire-safety guidance | Consumer sale and use are prohibited without the required professional licensing and permits; sparklers are included. |
| California | State Fire Marshal fireworks program | Check Safe and Sane classification, business licensing, sales windows and local permission. A state-approved product can still be prohibited locally. |
| Any other state or locality | State fire marshal and local fire authority | Check products, importer/wholesaler/retailer permissions, storage, sales dates and use restrictions separately. |
Do not treat a permissive state as permission for every county, city or retail format. Record the authority consulted and the date of your check. Verify warehouse rules even if your intended buyers are elsewhere.
What to Ask Your Chinese Supplier
Copy this request into your RFQ: “For each SKU, please provide the product description and intended use; UN number and division; applicable EX, FC or FW documentation; test records supporting US consumer-product compliance; English label artwork; units per case, carton dimensions and weights; and proposed export/shipping documents. Identify the producing factory, exporting party and any substitutions requiring our written approval.”
Have the broker confirm customs classification, bond, entry documents and applicable duties rather than using a supplier's estimate as a binding answer. Review the 1.4G versus 1.3G comparison and the information layout on this sample Wanzai supplier profile. Sample listings are not verified compliance evidence.

Frequently Asked Questions
Do I need an ATF license to import 1.4G fireworks?
Generally not for completed consumer fireworks that actually meet the exemption. The 1.4G label alone is insufficient; display-fireworks importation requires the applicable ATF license.
What happens if CPSC finds a non-compliant shipment?
Non-compliant devices cannot be sold. Follow the specific detention or enforcement notice; the scope of the hold and options for disposition depend on the findings and authorized procedure.
Can I sell consumer fireworks in California?
Only within the applicable state classification, licensing and sales rules and where local law permits. Check State Fire Marshal approval and local restrictions before selecting stock.
Who is responsible for US compliance: me or the factory?
The US importer must meet its own certification and import obligations. Supplier warranties and contractual remedies do not remove those duties; retain testing, identity and shipping records.
